At Your First Meeting With Us

We will let you know what documents you need to collect or create. For example, we urge you to fill out the proper New York State Divorce Forms that state the grounds for divorce (the marriage is irretrievably broken down for at least six months), the number of children you have and your plans regarding child custody and asset distribution. You should also collect your tax returns, bank statements, and proof of debt. Doing so at the beginning of divorce proceedings will help the process go faster, which will be cheaper and easier for you.

The residency requirements for divorce in New York are as follows:

  • At least one spouse must be a  New York resident for at least one year before filing for divorce
  • The couple was married in New York
  • The couple lived as husband and  wife in New York State for at least one year before filing for divorce
  • The grounds for divorce took place in New York State and both parties were residents at the time of the commencement of the action for divorce

How Easy Is It To Change Attorneys?

Simply call the Law Office of Laurence S. Margolin and set up an appointment to meet with a member of our dedicated staff. We will then do the following:

  • Contact your previous lawyer
  • Prepare a Consent to Change Attorney Form and arrange for your prior attorney to sign it
  • Have your file delivered to us
  • Get the balance of any fees from your prior attorney sent to you
  • Find out the balance of any fees your prior attorney claims to be owed by you


The Law Office of Laurence S. Margolin will speak directly with your former attorney and arrange for them to sign a Consent to Change Attorney.

  

We will also file the Consent Form and Retainer Agreement with the Court to ensure a smooth transition. There is no charge for this service.
